Anti-corruption compliance service

Compliance (from the verb to comply) literally means to comply, i.e. to act in accordance with a request or instruction.

Compliance is conformity to some internal or external requirements or norms.

The concept of compliance appeared in Central Asia and the Caucasus countries in the early 2000s, and first of all, banks became interested in risk management. A little later, compliance became a necessity for companies from other sectors.

On 06 October 2020, the President of Kazakhstan signed the Law of the Republic of Kazakhstan “On Amendments and Additions to Certain Legislative Acts on Anti-Corruption”, where the main emphasis was placed on amendments in the area of establishing compliance services in quasi-governmental entities.

Since 17 October 2020, in accordance with paragraph 3 of Article 16 of the Law of the Republic of Kazakhstan dated 18 November 2015 No. 410-V ZRC “On Combating Corruption” (hereinafter – the Law), a structural unit or a responsible person performing the functions of anti-corruption compliance service has been normatively defined in the subjects of the quasi-public sector.

The main task of the anti-corruption compliance service is to ensure that the organisation and its employees comply with the anti-corruption legislation of the Republic of Kazakhstan.

Within the framework of implementation of the Laws, the Board of Directors of the non-profit joint stock company “International University of Tourism and Hospitality” (hereinafter referred to as the Company) in the organisational structure of the Company has provided for an Anti-Corruption Compliance Service reporting to the Board of Directors of the Company, Minutes No. 1 dated 21 April 2022.

The Board of Directors of the Company appointed the Head of the Anti-Corruption Compliance Service (hereinafter referred to as the Service), Minutes No. 9 dated 27 December 2022.

The main purpose of the Service’s activities is:

  • ensuring compliance by the Company and its employees with the legislation of the Republic of Kazakhstan on combating corruption;
  • monitoring the implementation of anti-corruption measures.

The tasks of the Service are:

  • ensuring implementation of tools for warning and prevention of corruption offences by the Company and its employees;
  • effective implementation of the system of anti-corruption measures in the Company;
  • Ensuring the Company’s internal analysis of corruption risks;
  • ensuring compliance with external regulatory requirements and international best practices on anti-corruption issues;

ensuring compliance with the basic principles of anti-corruption in accordance with the Law.
